Disclosure requirements: When must you tell clients that AI was involved in their matter? New Jersey's evolving guidance is clear: if it affects the attorney's competency or the service provided, disclosure is required.

Verification protocols: How will you catch AI hallucinations and errors? Legal research gets spot-checked against primary sources. Contract analysis gets a final human review. This is non-negotiable.

Prohibited uses: What will you never use AI for? Submitting briefs without human review? Generating citations without verification? Making judgment calls on complex legal matters?

Training and competency: How will you and your staff stay current on AI capabilities and limitations? This needs refreshing at least quarterly.

Documentation: You need records showing that AI was used appropriately. Not just for compliance—for your own protection.

The New Jersey Specific Angle

New Jersey's Supreme Court and the NJSBA task force have been moving deliberately and thoughtfully on this. The guidance is practical and acknowledges that AI in legal practice isn't going away. What they're requiring is competency, transparency, and diligent human oversight.

If you're practicing in New Jersey, you need to reference that guidance in your policy. Not because it's legally binding yet, but because it shows you're taking your obligations seriously. When an ethics complaint comes in, or when a client questions your use of AI, having a documented policy that aligns with NJSBA guidance is your first line of defense.

The Real Cost of Not Acting

Here's what happens if you don't implement a policy:

You'll eventually use AI in a way that creates liability. Maybe it's a missed deadline that you think was on your calendar (but the AI assistant never actually created it). Maybe it's a contractual obligation you missed because AI-powered contract review missed a clause. Maybe it's a research gap that creates a malpractice problem.

When that happens, and a client or opposing counsel questions it, you won't have documentation. You won't have a vetted process to point to. You'll just have the problem.

And if it escalates to an ethics complaint or a malpractice claim, you'll be explaining why you didn't have a policy. You'll be saying, "I was using AI, but I didn't really have a formal system." That's a conversation you don't want to have.

What to Do This Week

Start simple. You don't need to hire a consultant. Document a basic policy in a Google Doc or Word file. Cover the five areas above. Make it specific to your practice—what you do, what you use, what you won't use.

Then share it with your malpractice insurance provider. Ask if it aligns with their expectations. Most insurers are grateful when they see solo practitioners taking this seriously.

Finally, commit to reviewing it quarterly. Technology moves fast. Your policy needs to keep pace.

The practitioners who move first aren't the ones who get called out. They're the ones who can confidently say, "Yes, I use AI. Here's how. Here's my process. Here's how I verify." That's a position of strength.

The ones who wait? They're the ones writing apology emails to ethics boards.
